Service terms
These terms govern the design, build, and care services Fixed Sites provides. By paying for a build or starting a care plan, you agree to them. Questions? Email noahbryant11@gmail.com.
The agreement
Fixed Sites designs, builds, and launches websites, and offers an ongoing care plan for hosting, security, and updates. When you pay a build invoice or start a care plan, you and Fixed Sites enter into an agreement on these terms. If you do not agree, do not pay.
What we do
We design and build your site, launch it, and keep your existing site up while we work. The care plan covers hosting, security, and the updates you send us, handled by the team that built the site. We use commercially reasonable effort and judgment to do good work.
What we do not guarantee
We do not promise specific business outcomes. That includes search rankings, the amount of traffic, conversion rates, leads, sales, or revenue. We also do not promise that the site will be free of every bug or that hosting will never have an interruption. Hosting and uptime are provided on a commercially reasonable basis, not as a guaranteed service level.
Your responsibilities
You confirm that you have the rights to the text, images, logos, and other materials you give us, and that they do not infringe anyone else's rights. You are responsible for your business, the products and services you offer, and following the laws that apply to them. You agree to keep your portal login secure.
Limitation of liability
To the fullest extent permitted by law, the services and your website are provided on an "as is" and "as available" basis, without warranties of any kind beyond those expressly stated here.
To the fullest extent permitted by law, Fixed Sites is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, or business interruption, arising out of or relating to the services or the website, even if we have been advised of the possibility.
Fixed Sites' total cumulative liability for any and all claims arising out of or relating to the services is limited to the total amount you paid to Fixed Sites for the services that gave rise to the claim during the twelve months before the event that caused it.
Nothing in these terms limits any liability that cannot be limited under applicable law, including for gross negligence, willful misconduct, or fraud.
Third-party services
Your site relies on third parties such as hosting providers, the domain registrar, and Stripe for payments. We are not responsible for their outages, errors, or actions, and their own terms apply to their part of the service.
Indemnification
You agree to defend and hold Fixed Sites harmless from claims, losses, and costs arising out of the content you provide or the way you use your site, including any claim that your content or business infringes a third party's rights or breaks the law.
Payments and the care plan
The build is billed once, up front, at the fixed price quoted. The care plan is billed monthly and continues until you ask us to stop. Payments run through Stripe, and your acceptance of these terms is recorded at checkout.
Governing law
These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in Georgia.
Changes to these terms
We may update these terms from time to time. The current version always lives at this page, and the version in effect when you pay is the one that applies to that payment.
